Apparently, you can go too far on satellite radio. But whether crude comments about the secretary of state will get two radio hosts fired remains to be seen.

In a situation that led to an on-air apology Friday morning, shock jocks Opie & Anthony were scolded by their employer, XM Satellite Radio, which called the offending sketch deplorable.

That kind of defensive move by XM wasn't supposed to be required in the satellite programming business, because it operates beyond the purview of the Federal Communications Commission. Indeed, a good part of the original lure of XM and its rival, Sirius Satellite Radio, was the way hosts like Howard Stern could finally say whatever they wanted.

Turns out, for a variety of reasons, that isn't necessarily so.

A representative for Trojan condoms said yesterday that the company would no longer advertise on the “Opie & Anthony” show on a CBS-owned FM station in New York after a guest on another version of the show, on XM satellite radio, mused about sexually assaulting Secretary of State Condoleezza Rice, leading to a vulgar discussion.

XM Satellite Radio (XMSR) favorites Opie and Anthony made some sexual remarks about Queen Elizabeth and Condoleezza Rice. The show hosts made an obligatory apology and XM said it was embarrassed and ashamed. The duo will be back on the air as scheduled. Sirius (SIRI) has its own version of shock radio in Howard Stern.

All of this may be a problem as the two satellite radio operators try to merge. Congress and the FCC are looking hard at the deal. Their biggest problem so far is that they think the combination could form a monopoly. Not good for the consumers and all. The fact that the two companies are close to financial failure doesn't seem to matter.





CBS Radio Pulls Show After D.J.’s Prank Call to Chinese Restaurant

One month after the firing of radio host Don Imus, a pair of suspended New York shock jocks have been permanently pulled from the air by CBS Radio for a prank phone call rife with Asian stereotypes.

“The Dog House with JV and Elvis,” featuring Jeff Vandergrift and Dan Lay, “will no longer be broadcast,” CBS Radio spokeswoman Karen Mateo said yesterday.

CBS Radio dismissed Mr. Imus in April for a comment he made about the Rutgers women’s basketball team. He plans a $120 million breach of contract lawsuit.

Imus hires attorney, will likely sue CBS


NEW YORK (CNN) -- Former radio talk show host Don Imus has hired one of the country's top trial lawyers to sue CBS Radio following his dismissal last month for making racial and sexual on-air comments about members of the Rutgers University women's basketball team.

Attorney Martin Garbus told CNN Wednesday that he has agreed to represent Imus in a wrongful breach of contract suit against his former employer.

Garbus would not disclose when he was retained by Imus but said he plans to file an action against CBS in the near future. Calls made to Imus by CNN were not returned.

A CBS spokesman declined comment.


Imus to sue CBS, plots to get back on air


Don Imus is preparing to sue his former employer — and plotting a possible return to radio.

The radio jock, who was fired by CBS for ripping the Rutgers women's basketball team with a racist, sexist insult, has hired Martin Garbus, a top First Amendment lawyer, to help him recoup the $40 million left on his contract.

Imus also has told friends that he's hoping to be back on the radio within months.

The radio talk show host Don Imus was suspended for two weeks yesterday after the outcry over his racially disparaging remarks about the Rutgers University women’s basketball team.
The suspension will begin Monday.

NBC News, which does a simulcast broadcast of Mr. Imus’s radio program on its cable news channel MSNBC, was the first to act, suspending Mr. Imus and calling his comments “racist and abhorrent.”

US shock jock Don Imus, who has made a career out of outrageous comments, has been suspended by the radio and television networks that carry his popular program for making racist remarks.

Both CBS Radio and MSNBC, which broadcasts the radio show on television, suspended the acerbic Imus for two weeks for saying the mostly black Rutgers University women's basketball team looked like a bunch of "nappy-headed hos". Hos is slang for whores.

Don Imus under fire for racist comments

Don Imus is under scrutiny for racist comments he made last week, even if he says he's sorry. From The New York Times:

Given that Mr. Imus spent part of last week describing the student athletes at Rutgers as “nappy-headed hos,” you might think he’d have trouble booking anyone, let alone A-list establishment names.

But Mr. Imus, who has been given a pass for this sort of comment in the past, also generously provides airtime to those parts of the news media and political apparatus that would generally be expected to bring him to account.

Mr. Imus’s comment about the Rutgers team last week was not just, as they say, over the line — you can’t even see the line from where he landed. It was not a gaffe, a slip of the tongue, a joke in poor taste.

(Nor was the on-air comment to Mr. Imus by the show’s longtime producer, Bernard McGuirk, calling the women’s final the “Jigaboos vs. the Wannabees,” in a bad attempt to borrow a phrase from a Spike Lee movie.) Mr. Imus’s slur was the kind of unalloyed racial insult that might not have passed muster on a low-watt AM station in the Jim Crow South.

Did you hear the latest example of Don Imus’ utter lack of social graces? First the dude wears a cowboy hat around like he’s freaking John Wayne—or, I guess Gene Wilder from Blazing Saddles would be more appropriate—and then he somehow manages to wrangle a job on talk radio despite being less coherent than Mushmouth from the old Fat Albert cartoon. Now Don Imus has the gall or balls or gumption or stupidity to refer to African-African members of a college basketball teams as “nappy headed hos” on air. Since the only people who actually listen to Don Imus are NASCAR-watching, beer-swilling, gun-totin’, Bush-voting walking lobotomy patients, I can only assume that he thought nobody with more than half a brain left in his head would hear this terminology and be offended.

Sharpton to Meet With Imus On-Air

NEW YORK -- Even as he scheduled an on-air meeting with radio host Don Imus, the Rev. Al Sharpton said he still wants Imus fired for his racially charged comments about the Rutgers University women's basketball team.

Sharpton said Sunday he intends to complain to the Federal Communications Commission about the matter.

"Somewhere we must draw the line in what is tolerable in mainstream media," he said. "We cannot keep going through offending us and then apologizing and then acting like it never happened. Somewhere we've got to stop this."

Sharpton and MSNBC announced that Imus would appear Monday on Sharpton's nationally syndicated program. Meanwhile, the Rev. Jesse Jackson planned a protest in Chicago, and an NAACP official called for Imus' resignation or firing.
